Terms of Service
Rights
These terms and conditions are strictly for Non-Commercial/Personal-Use only clients.The artist: Marsmalloey reserves the right to refuse service at her own discretion.The artist: Marsmalloey maintains all rights to all artwork including all various stages leading up to and the completed work. Artwork may be used for but not limited to portfolios (physical and online), examples, prints, social media, art advertisement, and Patreon rewards. Client maintains all rights to character ownership and/or concepts and will be accredited in any public posts or social media.Clients who share the completed artwork to their online collections or social media platforms must credit the original artist: Marsmalloey. This includes profile pictures or background images for personal websites.Do not claim the completed artwork as your own and removal of watermarks or signatures is strictly prohibited.
This is non-negotiable.
COMMERCIAL REVENUE & RESALE
Unless a fee is paid, Clients do not have permission to sell or use commissioned artwork for personal revenue. This includes but is not limited to prints, t-shirts, stickers, bags, keychains, etc. featuring the commissioned work is strictly prohibited if not purchased directly from the artist. Requests for these items for personal use only must be approved by the artist before purchase.
Revisions
Any and all edits to the artwork must be done by the artist. The client does not have permission to make any revisions to the completed artwork.
Removal of original watermarks or signatures is prohibited. Any revisions to the artwork must be stated by the client during the preliminary sketching phase. Any major revisions requested by the client during the lining phase may be subjected to a fee per the artist’s discretion. No revisions will be done once the artwork is completed.
Payment & Refunds
All prices are final and non-negotiable. All payments will be requested after the details of the commission are discussed, please be sure to include the email linked to payment. 50-100% of payment must be sent before the artist will proceed with a first draft, percentage is per the artist's discretion. Payment plan and more discount options may be available for returning clients with good payment history, also per the artist’s discretion. If first payment is not completed within 48 hours of the invoice being sent, the commission will be canceled. As soon as the first draft is finished and sent, there will no longer be any full refunds available, regardless if the client cancels before the commission is completed. Upon satisfaction with the first draft any remaining payment will be due if not initially paid in full.
TIME FRAMES & DEADLINES
Due to personal scheduling, projects will have no set time frame or deadline for completion unless stated otherwise. Any projects requiring a deadline or set time frame for completion may be declined per the artist’s discretion. Any cancellation of a commission order due to prolonged time frame by the client in which the artwork has already been started, will be done so with the full knowledge that there will be no refund given (unless artist has yet to submit a first draft). PayPal “charge-backs” or disputes submitted by client due to prolonged time frame after the artwork has been started will result in a blacklisting and any future commission privileges being revoked.
Privacy
Commission information including but not limited to client’s online username, character name, commission type, coloring preference, and invoice number may be posted in order to track commission progress both for the artist and client. If there is any information concerning the commission that the client does not want posted publicly, it should be specified in the order or via email correspondence with the artist. For confidentiality and security purposes, client’s full name will never be posted publicly unless prior consent is given. Artwork is subject to public online streaming unless otherwise explicitly specified by the client.
